LEAVE IN ESTABLISHMENT COVERED UNDER THE SHOPS AND ESTABLISMENTS ACTS


Employees are entitled to leave apart from designated holidays and days off during the course of employment. There are different types of leaves yet three of them are recognized under the Shop and Establishments Act, they are-

Earned/Privilege Leave (EL)- Earned leaves are entitled leaves for the employees for the reason of being employed in a specific company. The leave entitlement is based on the number of days employees are working with the company. These leaves need to be approved unless in terms of emergency and such leaves are planned according to the policy of the company in-line with relevant regulations

Casual Leave (CL)- Casual Leaves are given in terms of urgent and unforeseen matters for half-day or one day off. Half days refer to the leaves when employees take leave for first half of the day or the second half for the purpose of personal affairs such as going to bank, attending PTMs and other personal reasons. One day leaves are also similar but is taken by the employees for a specific day.

Sick Leave (SL)- Sick Leaves are approved in terms of medical emergency and when employees fall sick and cannot come to office for a definite period of time, there are conditions attached with Sick Leave. Based on the nature and number of leaves, the employer is empowered to ask for medical certificate from the employee. Each state in India has their own number against the Leaves under the Shop and Establishment Act and Rules made under. But the similar numbers shall not be applicable to industrial establishments like factories. It is applicable for Commercial Establishments, Shops, retail stores, malls, warehouses, eateries, cinema halls, amusement parks, hotels, finance sector, healthcare, IT companies, administrative offices and source of entertainment hubs
