The Constitution of India, under Article 326, clarifies the right to vote in the election of the House of the People and to the Legislative Assembly of States by Indian citizens who have completed the age of 18 years.

Section 135B of the Representation of the People Act, 1951, clarifies the grant of paid holiday to the employees on the day of the poll.
Every employed person in any business, trade, industrial undertaking, or other establishment entitled to vote at an election to the House of the People and to the Legislative Assembly of the State shall grant a paid holiday on the poll day. There is no deduction of wages to be made for such an account of paid holiday granted on poll day.
In cases where the nature of employment or elector who's absent may cause danger or substantial loss in respect of the employment in which the employee works, the above will not be applicable. In case any employer refuses to grant the paid holiday or deduct the wages of the employees, it will amount to a non-cognizable offence under Section 135B of the Representation of the People Act, 1951, which shall be punishable with a fine that may extend to Rs.500/-.

Under Indian labour law, State level legislation is empowered to declare paid holidays to the electorate employees of the House of the People and to the Legislative assemblies of State under the special power made under the Shops and Establishment Act / Industrial Establishment (National and Festival) Holidays Act. The respective legislation clarifies the procedures and compensation on engagement of employees for the declared holidays.
